1. About these Terms
These Terms of Service (the “Terms”) apply to consumer purchases made through frikandeal.com (the “Store”). The Store is operated by FRIKANDEAL B.V. (“FRIKANDEAL”, “we”, “us” or “our”). By placing an order, you agree to the version of these Terms made available to you before checkout.
These Terms do not limit any rights that cannot lawfully be excluded or restricted. If a provision conflicts with mandatory consumer law, that mandatory law takes priority.

3. Products and product information
We sell physical products including sealed sports-card and trading-card products, collectible products and related accessories. We aim to describe and display every product accurately. Images may be illustrative, and minor differences in packaging, colour or manufacturer presentation may occur.
Unless a product page expressly states otherwise, purchasing a sealed or randomised collectible product does not guarantee any particular card, player, autograph, rarity, “hit”, grade or resale value. Manufacturer checklists, stated odds and box configurations are manufacturer information and may be subject to the manufacturer’s terms. Nothing in this section affects your statutory rights if the product does not conform to the contract.
4. Orders and formation of the contract
You can review and correct your order before submitting it. By selecting the final order button, you submit an offer to purchase the products in your order and accept an obligation to pay.
We will send an electronic message after receiving your order. A binding contract is formed when we send an order confirmation that accepts your order. If a message expressly states that it only acknowledges receipt, it does not constitute acceptance.
Before accepting an order, we may decline it because a product is unavailable, payment cannot be authorised, delivery restrictions apply, fraud or misuse is reasonably suspected, or there is an obvious pricing or product-information error that you knew or reasonably should have known was an error. If we cannot accept an order, we will notify you and promptly refund any amount already paid.
5. Prices and payment
Prices displayed to consumers for delivery within the European Union include VAT unless the Store clearly states otherwise. Delivery charges and any other mandatory costs are shown before you place the order.
Available payment methods and the time at which payment is collected are shown at checkout. Any mandatory right to choose a payment option under which part of the price is paid after delivery remains unaffected. If you order for delivery outside the European Union, you may be responsible for import duties, taxes and customs charges imposed by the destination country.
Promotional prices and discount codes are subject to their stated conditions and validity period. Unless we state otherwise, promotions cannot be combined.
6. Delivery and transfer of risk
Delivery options, charges and estimated delivery times are described at checkout and in our Shipping Policy. We will deliver within the agreed period. If no period has been agreed, we will deliver without undue delay and no later than 30 days after the contract is concluded, unless a different period is permitted by applicable law.
For consumer orders, the risk of loss or damage remains with us until you, or a third party designated by you other than the carrier, physically receives the goods. If you independently appoint a carrier that we did not offer, risk may transfer when the goods are handed to that carrier, as permitted by law.
If delivery is delayed or fails, please contact us. Your mandatory rights concerning late or failed delivery remain unaffected.
7. Right of withdrawal and returns
If you are a consumer with a statutory right of withdrawal, you may withdraw from your online purchase without giving a reason within 14 days after you, or a third party designated by you other than the carrier, receives the goods. For a single order delivered in separate parts, the period starts when the last item or part is received.
To withdraw, use the clearly identified digital withdrawal function on our Store, use the model form at the end of these Terms, or send us another clear statement by email or post before the withdrawal period expires. You do not have to use the model form. If you use our digital function, we will promptly confirm receipt by email. Full instructions are also available in our Return and Refund Policy.
After notifying us, you must send the goods to the return address in Section 2 without undue delay and no later than 14 days after your withdrawal notice. For a change-of-mind return, you bear the direct cost of ordinary return shipping where we informed you of this before purchase. We bear the necessary return cost if the product is defective, damaged, incorrect or otherwise non-conforming.
We will refund the price paid and the cost of the least expensive standard delivery method we offered. We will make the refund without undue delay and no later than 14 days after receiving your withdrawal notice. We may withhold the refund until we receive the goods or you provide evidence that you sent them back, whichever occurs first. Unless you expressly agree otherwise, we will use the original payment method and will not charge a refund fee.
You may inspect a product only as you would reasonably be permitted to do in a physical shop. You are responsible for any reduction in value caused by handling beyond what is necessary to establish the product’s nature, characteristics and functioning. Opening manufacturer-sealed collectible products can cause a substantial loss of value where the contents, scarcity or market value depend on intact packaging. Any deduction will be based on the actual, objectively supportable loss in value; we do not automatically refuse a statutory withdrawal solely because a trading-card product’s seal was opened.
The statutory right of withdrawal does not apply where a lawful exception applies, for example to personalised goods, goods liable to deteriorate rapidly, sealed goods that are unsuitable for return for genuine health-protection or hygiene reasons once unsealed, or sealed audio, video or computer software once unsealed. These exceptions are interpreted narrowly and do not limit your rights concerning defective or non-conforming goods.
8. Cancellation before fulfilment
You may request cancellation of an unfulfilled order using the cancellation function made available by us or by contacting info@frikandeal.com. If we confirm cancellation, we will refund any amount paid. Once fulfilment or shipment has begun, cancellation may no longer be operationally possible, but any statutory withdrawal rights remain unaffected.
9. Statutory conformity and legal guarantee
We are responsible for supplying goods that conform to the contract. Products must have the quality, functionality and other characteristics that you may reasonably expect, taking account of their description, price, nature and any specific statements we made.
If a product is defective, damaged, incorrect or otherwise non-conforming, contact us as soon as reasonably possible with your order details and, where useful, photographs. A delay in notifying us does not remove rights that mandatory law gives you.
Depending on the circumstances and applicable law, you may be entitled to a free repair or replacement and, where the legal conditions are met, a proportionate price reduction or termination of the contract and refund. We bear the necessary costs of providing a statutory remedy. These rights exist independently of any commercial or manufacturer’s warranty. Under Dutch law, the duration of conformity protection depends on the reasonable expected lifespan of the product rather than a fixed commercial-warranty period.
10. Accounts and electronic communications
You must be legally capable of entering into a purchase contract. If you are under 18, you may order only with the consent of a parent or legal guardian.
You are responsible for providing accurate information and for keeping account access details confidential. Tell us promptly if you suspect unauthorised use of your account. We may suspend access where reasonably necessary to protect you, other customers or the Store.
Order confirmations, invoices, notices and other contract information may be provided electronically to the email address you give us. After the contract is formed, we will provide the required contract information in a form you can retain, such as an email or PDF. Please save these documents for your records.
11. Acceptable use of the Store
You may not misuse the Store or use it for unlawful or fraudulent purposes, interfere with its security or operation, introduce malicious code, scrape it in a way that disrupts the service, impersonate another person, infringe intellectual-property rights, or attempt unauthorised access to systems or data. We may take proportionate measures, including restricting access or cancelling fraudulent orders, where reasonably necessary and lawful.
12. Intellectual property
The Store’s original content, branding, design and software are owned by or licensed to us and are protected by intellectual-property laws. You may use the Store for personal, non-commercial shopping. No ownership rights are transferred to you. Product names, images and trademarks belonging to manufacturers or other third parties remain the property of their respective owners.
13. Store platform, third-party services and links
Our Store is hosted on Shopify, which provides the ecommerce platform we use. Your purchase contract is with FRIKANDEAL B.V., not Shopify. Payment, delivery, authentication and other functions may be provided by identified third-party service providers under their own terms and privacy notices.
The Store may link to third-party websites. We are not responsible for independent third-party content or services, but this does not exclude responsibility that applicable law places on us for services we select or use to perform our contract with you.
14. Privacy and cookies
We process personal data as described in our Privacy Policy. Information about cookies and available choices is provided through our cookie-preference tool and privacy information. Where Shopify processes data for its own purposes, the applicable Shopify Consumer Privacy Policy also applies.
15. Liability
We are responsible for loss that is a foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to applicable law. We are not responsible for loss that was not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made wholly as a consumer.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct, mandatory product liability, or breach of mandatory consumer rights.
16. Events outside our reasonable control
We are not responsible for delay caused by an event outside our reasonable control where and to the extent permitted by law. We will take reasonable steps to reduce the effect of the event and inform you if it materially affects your order. Your mandatory rights concerning delivery, cancellation and refunds remain unaffected.
17. Complaints
Please send complaints to info@frikandeal.com or to the postal address in Section 2, including your order number and a clear description of the issue. We will acknowledge and handle your complaint as soon as reasonably possible.
If we cannot resolve a dispute directly, you may have access to an authorised alternative dispute-resolution body in your country. We will provide any information about our participation in a specific dispute-resolution procedure where applicable. This does not restrict your right to bring proceedings before a competent court.
18. Governing law and jurisdiction
These Terms and our contracts are governed by Dutch law. If you are a consumer who habitually resides in another country, this choice does not deprive you of the protection of mandatory consumer-law provisions that would apply in your country without this choice.
Disputes may be submitted to any court that has jurisdiction under mandatory applicable law. Nothing in these Terms limits a consumer’s right to bring a claim in the courts available to them under applicable consumer-jurisdiction rules.
19. Changes, severability and waiver
The Terms made available to you when you place an order govern that order. We may update these Terms for future orders, for example to reflect legal, operational or service changes. The date above shows when this version was last updated.
If a provision is found invalid or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right does not waive that right.
